Alcohol Interlock Programme (AIP)

The bill Alcohol Interlock Programme was passed by the Senate on 1 June 2010 and became law on 4 June 2010. The draft ministerial regulations setting out the technical requirements for alcohol interlocks and manufacturers are now ready and the definitive version is expected in the autumn of 2010. The Ministry of Transport, Public Works and Water Management is aiming to introduce the alcohol interlock programme as a measure for serious alcohol offenders from mid-2011. What does this mean for manufacturers?

Programme for alcohol offenders
The AIP is aimed in particular at serious alcohol offenders. When participating in the AIP, these offenders have to let an alcohol interlock be installed in their vehicle: a breath tester that acts as a starting block that forces the driver to refrain from drink driving. The blocked state is only released after a valid breath test has been carried out with a breath alcohol concentration (BrAC) below the limit of 90 µg/l. The participant has to have his alcohol interlock read out periodically.

Support
Moreover, the participant shall follow a support programme. The support programme supports participants in participating constructively in the AIP and in separating alcohol consumption from driving. An important element of the support programme is feedback and support based on the data read out regularly from the alcohol interlock memory. The standard period for the AIP is two years. If during the standard period of the AIP the participant has still not been able to demonstrate that he can separate driving a vehicle and alcohol consumption, there is the option to extend the AIP repeatedly by six months at a time. The participant remains in the alcohol interlock programme until he has demonstrated that he can separate alcohol consumption and driving.
Typeapproval for alcohol interlocks, designated manufacturer and designated installers

Participants of the Dutch AIP may only use an alcohol interlock that is typeapproved by the Dutch government, supplied by a vendor that is designated by the Dutch government and installed by an installer that is designated by the Dutch government. A manufacturer of alcohol interlocks who wants his alcohol interlocks to be used by participants of the Dutch AIP thus has to fulfil a number of procedures:

  • The alcohol interlocks need to become typeapproved. To receive type approval for the interlocks, the interlocks have to comply with the technical requirements, as formulated in the Vehicles Regulation (Regeling Voertuigen).
  • The legal representative of the manufacturer in the Netherlands has to become designated. Therefore, the legal representative of the manufacturer has to comply with the requirements formulated in the Vehicles Adaptation Regulation [Regeling Aanpassing Voertuigen].
  • Installers must also become designated. Installers can become designated when they comply with the requirements for formulated in the Regulation Adjusting Vehicles [Regeling Aanpassing Voertuigen].


The RDW is responsible for issuing typeapprovals and authorisation of vendors and installers.

Draft regulations

At this website the draft regulations are published versions. The regulations have been notified at the European Union. Members of the European Union did not have any significant remarks. The notification is now effective The regulations will be finalized. The final regulations will be published at this website as soon as they are finished. Moreover, the regulations have been developed in Dutch. The European Committee translated the requirements in English and a number of other languages. The Dutch government does not take any responsibility for the English translation. In the end, only the Dutch version will be valid.
